White Raven Publications reserves the right to use the same or similar template with other clients. 1.2. The website content supplied by the client to White Raven, to be added to the design template, remains the copyright of the client or the original author. 1.3. In the event of the client supplying us with artwork, images or written content you warrant that you have copyright for the use of that material or have written permission from the original owner to use the material on the website. 1.4. White Raven Publications will under no circumstances be responsible for any copyright issues that arise as a result of you supplying us with any material in breach of copyright. 1.5. Domain names remain the property of the client. The Client agrees to indemnify White Raven Publications, including any incidental costs, against any claims that a Domain Name applied for, or obtained, violates the intellectual property rights of a third party. Right to refuse 2.1. White Raven Publications maintains the right to refuse publication of any material that is deemed to be of very low quality or is in contradiction with our business morals and principles. This may include but is not limited to low quality artwork and immoral or illegal materials 2.2. We reserve the right to terminate any accounts, at any time, as deemed by white raven publications, where the user has made inappropriate or unreasonable use of any of the White Raven services. ........................................................................................................................................... 3. Prices 3.1. White Raven Publications reserves the right to alter the prices of our service without any prior notice. ........................................................................................................................................... 4. Payments 4.1. Any initial set up fees and a minimum of at least one month’s payment are to be made in advance of the website going live. 4.2. Additional monthly payments are to be made in advance. 4.3. White Raven Publications retains the right after 30 days of non payment to suspend the account and website until payments have been made in full for the outstanding period. ........................................................................................................................................... 5. Cancellations 5.1. If you wish to cancel your web site you may do so at any time in writing. Any payments made in advance can not be refunded. Your final account will terminate on the last day that any payment is due. On request your website can be stored for reactivation at a later date. 5.2. On cancellation of the account the domain name remains the responsibility of your self for upkeep and repayment. ........................................................................................................................................... 6. Delivery 6.1. We will always aim to deliver your product in the quickest possible time. 6.2. We do not have any control over external internet service providers including domain name registration services. Some deliveries may be delayed due to disruptions or lack of support from these parties. In these instances, White Raven Publications will not be liable for any consequential loss. 6.3. Our service turnaround time is based on the time it takes for the material for the website being supplied for the completion of the website. Our turnaround time excludes weekends and bank or public holidays. 6.3. Transfers of existing domain names are dependant on third party internet service providers and domain name registrars and can often take up to a week to complete the domain name transfer. 6.4. Our aim for Maintenance and updates is to be carried out with in 24 hours. Any critical updates that are required must be submitted to White Raven allowing 48 hours for updates. ........................................................................................................................................... 7. Purchasing from White Raven Publications 7.1. You agree to allow White Raven Publications to showcase or feature the product on their web site or any other related web sites or in promotional literature. 7.2. The "Powered by White Raven" must remain intact in the footer of all client websites 7.3. All website designs and templates belong to White Raven Publications and may not be used elsewhere unless the design was originally owned by the customer and imported into the White Raven system. 7.4. The customer will fully indemnify White Raven publications against liability (of any nature), which may befall White Raven Publications as a result of the customers legal of illegal use of the services 7.5. We will not be responsible for any damages your business may suffer. We make no warranties of any kind, expressed or implied for services we provide. White Raven Publications disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non deliveries, wrong delivery, and any and all service interruptions caused by White Raven. 7.6. We are not responsible for any interruption of service, and accept no liability for any loss of services, sales or any other form of loss. 7.7. White Raven Publications generally conduct our work in- house although we reserve the right to sub-contract your work if we feel it is more suitable or necessary to do so. 7.8. The client is responsible for the proof reading their web site for any errors. White Raven will not be held responsible for any damages that your business should suffer due to any errors in the content. 7.9. White Raven reserves the right to alter these terms of conditions at anytime and without notice. 7.10. By instructing White Raven to proceed with the website and making a payment of invoice to use the services supplied, the Client acknowledges having read, understood, and accepts the Terms and Conditions of this Agreement, and agrees to be legally binding by these Terms and Conditions.
